JURISDICTION

writ of certiorari was filed on March 4, 1991, and is therefore substantially out
of time under Rule 13.1 of the Rules of this Court. The jurisdiction of this Court
is invoked under 28 U.S.C. 1254(1).
QUESTION PRESENTED
Whether, after remand from the court of appeals, the district court
sentenced petitioner to a presumptively vindictive sentence.
